No, not automatically. A High Risk rating tells you the study found significant obstacles, but it doesn't close the door. The Strategic Recommendation section of the study lays out the options available to you.
Options you may see in the recommendation
- Adjust the mark so it is more distinctive.
- Narrow the goods or services you plan to cover, so they no longer overlap with conflicting marks.
- Ask the owner of an existing mark for a consent agreement.
- Choose a different mark altogether.
