The European Union Intellectual Property Office (EUIPO) is the body that handles trademarks and designs for the whole EU, with the aim of supporting innovation.
Why choose a European Union Trademark
An EUTM gives you much the same protection as a national trademark: the right to use your mark in commerce is safeguarded. It is generally cheaper to obtain and to renew, and the process is simpler than filing nationally, particularly when you would otherwise need a separate local registration in every territory. An EUTM also covers the entire EU, and it continues to do so if the EU grows, with no need to file again.
When a national trademark may suit you better
If your business operates in just one region, a national trademark can be the more practical option, since a local attorney can manage it more easily.
Keep in mind that if you only use your mark locally, an EUTM that claims exclusivity across all member countries can be challenged by any national trademark within the EU.
Cancellation and invalidity proceedings
If you need to seek cancellation or a declaration of invalidity, proceedings before national courts are usually more costly than those before the EUIPO for an EUTM.
