Use as a filing requirement
Some countries only let you register a trademark if you are already using it, or plan to. In those places you file what is known as a use-based application, and the basis you claim for it can be any one of the following:
- The mark is being used right now in commerce.
- You plan to start using the mark in the marketplace.
- An application for the same mark is pending with a trademark office in another country.
- The mark is already registered abroad, and it is being used under that foreign registration.
